SUMMARY:NELA Webinar Series: Environmental Constitutionalism
DESCRIPTION:  \n  \nJoin NELA for our February Webinar on Environmental Constitutionalism. \nMore about the event and speakers \nAssociate Professor Dr Ron Levy  \nAssociate Professor Dr Ron Levy is a researcher on constitutional law at the Australian National University. He is the winner of several research and teaching awards and grants. His works explore referendums in deeply divided societies\, Indigenous constitutional reform and environmental constitutionalism. His recent paper on the latter is Ron Levy\, ‘Fixed Constitutional Commitments: Evaluating Environmental Constitutionalism’s “New Frontier”‘ (2022) 46(1) Melbourne University Law Review 82. \nLevy will be speaking about the global emergence of a type of ‘fixed’ constitutional provision that secures both a substantive environmental policy and its precise quantum of protection. These features are intended to curtail the vagueness\, open-endedness and interest-balancing that are standard in environmental constitutional rights. He will discuss existing cases from New York\, Bhutan\, Kenya and Victoria\, and also assess the possibility of future fixed constitutional commitments in the area of climate change. \nAssociate Professor Lulu Weiss \nLael (‘Lulu’) Weis is an Associate Professor at Melbourne Law School. Her research uses philosophical and comparative methods to analyse issues in constitutional theory\, including: legislation as a source of constitutional meaning; the significance of amendment for constitutional interpretation; and understanding constitutional duties\, such as directive principles. Her current research project explores principles of green (non-anthropocentric) constitutionalism and how constitutions allocate institutional responsibility for environmental protection. Lulu holds a PhD in Philosophy from Stanford University and a JD from Stanford Law School. She is a General Editor for the journal Comparative Constitutional Studies. \nLulu’s presentation will involve discussion of environmental constitutionalism and how it often focuses on the promise of impact litigation\, which seeks the direct judicial enforcement of constitutional environmental rights\, such as the right to a clean and health environment.  But this picture is misleading: most environmental constitutional provisions are formulated as duties rather than rights\, and are designed to be given effect by legislation rather than direct judicial enforcement.  This Webinar will consider the implications of these duties and legislation-based aspects of environmental constitutionalism.

She has over 35 year’s experience as a practising environmental lawyer. She is NRF’s first Sustainability Partner and co-Head of the NRF ESG group for EMEA. She is recognised as a Tier 1 individual in Chambers Legal Directory and is listed in the Legal 500 Hall of Fame and the Guide to the World’s leading environmental lawyers. \nCaroline is Chair of the Law Society of England and Wales Climate Change Working Group which produced what is believed to be the first professional services guidance from a professional body responding to the climate crisis anywhere in the world. As such the guidance has attracted a lot of interest from other professional bodies e.g. the Bar Council\, the IBA\, and other Law Societies around the world. Caroline will be presenting the guidance at COP 28 in Dubai later this year. \nCaroline is also Co-Chair of the Legal Sustainability Alliance an alliance of over 120 of the leading law firms in the UK sharing best practice and she is a Director of leading Sustainability NGO the Aldersgate Group currently chaired by former Prime Minister Theresa May MP. She is Freeman of the City of London. \nElizabeth Wild is Head of NRF’s Australian Environmental & Planning practice. With over 30 years’ experience and a particular expertise managing issues relating to contaminated land and remediation law\, Liz advises on all legal and strategic aspects associated with contaminated land including disputes regarding all forms of contamination\, strategies for the investigation\, remediation and marketing of contaminated land and obtaining planning and environmental approvals for the remediation and development of contaminated land\, and has been involved in many of the landmark cases in this area. \nLiz is also a member of NRF’s ESG practice. \nLiz is ranked in Chambers & Partners APAC 2023 and recognised as a Leading Individual in Environment & Planning Law by The Legal 500 APAC 2023. She has also been named Preeminent Lawyer in Environment & Climate Change in NSW by the Doyle’s Guide 2022. DESCRIPTION:Join us and environmental law experts\, Professor Benjamin Richardson and Matthew Austin\, to explore the origins and future Australian environmental law against the backdrop of significant environmental law upheaval. \nOur webinar ‘Rethinking the Origins and Future of Australia Environmental Law’ will explore the history of Australian environmental law\, the importance of reform\, and the role of national laws in promoting environment protection and restoration. \nMore about the webinar \nOur speakers will each give a short presentation\, before answering any questions from our viewers in a facilitated discussion. \nProfessor Richardson will speak about the misconceptions surrounding the history of Australian law reforms\, where historically the law profession was not active in law reform. Instead\, scientists\, journalists\, artists\, and bushwalkers pushed the reform agenda. Professor Richardson will explain why improving the nation’s current environmental laws is constrained by major\, systemic obstacles from the past. \nMatthew Austin will delve into the development of environmental law from a practitioner’s perspective\, discussing how significant case law and legislative changes have altered the public and private sectors’ understanding of environmental law. \nMore about the speakers \nBenjamin J. Richardson is a Professor of Environmental Law at the University of Tasmania. He has held academic positions in universities in Canada\, England\, New Zealand\, and the Netherlands\, including as a Canada Research Chair at the University of British Columbia before moving to Tasmania. Professor Richardson is currently completing an Australian Research Council-funded project on the role of conservation covenants to help Australia meet its 30 x 30 targets. His latest book\, Before Environmental Law: A History of a Vanishing Continent\, examines the origins and making of Australian environmental law. \nMatthew Austin is a Partner at King & Wood Mallesons\, specialising in environment\, planning and resources law. Matthew has over 25 years of experience advising a wide range of development\, infrastructure\, government\, resources and renewables clients. Matthew provides specialist advice on the operation of various State and Federal environment and planning assessment and approvals processes. DESCRIPTION:  \n \n  \n  \nOver the past three years\, the Asian Research Institute for Environmental Law (ARIEL) has been working with the ASEAN Environmental Rights Working Group (AER WG) established by the ASEAN Intergovernmental Commission on Human Rights (AICHR) on the development of an environmental rights framework for ASEAN. Following three AER WG meetings\, a draft document has been released for stakeholder consultation. The AER WG will meet again in early May to consider amendments to the document and to review submissions received during the stakeholder engagement process. To assist with the stakeholder consultation plan and future discussion on environmental rights in ASEAN\, ARIEL has established a website https://www.environmental-rights.net/ \nIn Australia\, the Joint Commonwealth Parliamentary Committee has been examining options for a Charter of Rights for Australia. Submissions to the inquiry have now closed\, and public hearings have been held. A number of environmental law groups made submissions urging the Committee to adopt provisions for the right to a clean\, healthy and sustainable environment and the procedural rights found in Principle 10 of the Rio Declaration – access to information\, public participation and access to justice.  \n Some submissions called on the Committee to recommend that Australia adopt the Aarhus Convention.  \n In this regard\, the webinar seeks to: \n●      Introduce the draft ASEAN Environmental Rights Framework \n●      Review the current discussion on environmental rights in the current Draft Charter of Rights. \n●      Consider how Australia could undertake an Aarhus Convention review to see what changes are required for Australia to comply with existing environmental and procedural rights norms. \n  \nTo register\, please use the QR code above.

DESCRIPTION:Wildlife crime is increasing globally\, posing a growing threat to Australia’s rich diversity of threatened and endemic species and natural ecosystems. Illegal harvesting\, killing\, and trading plants and animals also seriously threatens Australia’s tourism industry and its $100 billion agricultural\, forestry and fisheries exports. However\, existing laws have consistently failed to effectively deter and punish environmental crimes in Australia and around the world. In this seminar\, our speakers will make the case that in designing Australia’s new national environmental laws\, law makers must take the growing threat of wildlife crime seriously. The seminar will detail the changing nature of the threat that wildlife crime poses to biodiversity\, showcasing cutting-edge research at the intersection of science\, criminology and law\, and highlighting recent developments in international and European laws to combat wildlife crime. \nMore about the Speakers:  \nProfessor Phill Cassey is an inaugural Australian Research Council Industry Laureate Fellow\, head of the Invasion Science & Wildlife Ecology Group (a research-intensive laboratory at the University of Adelaide) and\, most recently\, discipline head of the University of Adelaide’s Department of Ecology & Evolutionary Biology. He is recognised internationally as a leading expert on wildlife crime and has published extensively (>300 papers) on the conservation\, transport and trade in animal species. Phill’s research has been adopted in environmental biosecurity arrangements by state and national governments in Australia\, and he is one of a small number of academics on the INTERPOL ‘Wildlife Crime Working Group’\, working to apply environmental biosecurity principles to combat demand and illegal wildlife trafficking. \nDr Daan van Uhm is Associate Professor of Criminology\, specialising in Green Criminology\, at the Utrecht University School of Law\, Willem Pompe Institute for Criminal Law and Criminology. His research focuses primarily on ‘green crimes’ and environmental harm\, including illegal mining in Latin America\, wildlife trafficking in Southeast Asia\, deforestation in Central Africa\, and the criminalisation of ecocide. Daan has a PhD in Criminology from Utrecht University\, on the topic: The Illegal Wildlife Trade: Inside the World of Poachers\, Smugglers and Traders (published by Springer). In 2018 he received the Veni grant of the Dutch Organisation for Scientific Research (NWO) for his research project ‘The Diversification of Organized Crime into the Illegal Trade in Natural Resources’. In 2022 he received the ERC Starting Grant (European Research Council) for the research project ‘Green Crimes and Joint Crime Ventures: Laundering Natural Resources’. \nDr Phil McCormack is co-convenor of the NELA’s Publications\, Submissions & Advocacy Portfolio\, and Future Making Fellow at the Environment Institute and Adelaide Law School\, The University of Adelaide. Phil is a climate and environmental law scholar. Her research critically evaluates Australia’s conservation laws\, highlighting legal and policy challenges and proposing reforms to help biodiversity adapt as the climate changes.
