DESCRIPTION:As a wave of climate change litigation is sweeping over the world\, domestic courts are employing different interpretive approaches towards the Paris Agreement. This webinar will offer a brief overview of some of them. \nThis webinar will be presented by Klimentina Radkova. Klimentina is a recent LL.M. graduate in Public International Law from the University of Oslo. She is passionate about legal issues concerning climate change\, biodiversity\, the interaction between environmental law and human rights and has focused her most recent research on the topic of climate change litigation. DESCRIPTION:Climate change litigation garners a lot of attention and is changing business activity. In this online session\, the Piddington Society in conjunction with NELA\, bring together a funder\, litigator and responder to climate litigation to consider the impact of climate change litigation\, where it is heading and current issues in this area of law. \nIn 2021\, Alan Schwartz AM\, a former lawyer\, revealed that he has been funding strategic litigation through the Grata Fund\, particularly on climate change matters. A former lawyer\, he will contribute this discussion sharing his perspective as a funder of litigation and will be joined by human rights lawyer Maria Nawaz (Grata Fund) who conducts this litigation. Lucy Shea (HWL Ebsworth) will consider the responses to climate change litigation and their impact on business decisions. Lea Hiltenkamp (National Environmental Law Association; HFW) will chair this session and lead the discussion. \nTickets are available here \n\nAttendees will be eligible for 1 CPD point in CA4 (Substantive Law). \n\nThis event will be conducted online\, via Zoom.

DESCRIPTION:This webinar hosted by several organisations in the Asia-Pacific region\, including NELA’s partner organisation\, the Asian Research Institute for Environmental Law\, presents an expert panel who will consider the proposed definition for the crime of ecocide.\nThe Independent Expert Panel for the Legal Definition of Ecocide\, chaired by barrister and author Philippe Sands QC (UK) together with UN jurist and former prosecutor Dior Fall Sow (Senegal)\, was convened in late 2020 at a powerfully symbolic moment\, 75 years after the terms “genocide” and “crimes against humanity” were first used at Nuremberg.\nCommissioned by the Stop Ecocide Foundation\, an expert drafting panel of 12 highly renowned international criminal and environmental lawyers from around the world has just concluded six months of deliberations. The result: a legal definition of “ecocide” as a potential 5th international crime\, to sit alongside genocide\, crimes against humanity\, war crimes and the crime of aggression.\nThe proposed definition of Ecocide is available on the newly launched Ecocide Law website\, an academic and legal resource hub co-managed by the Stop Ecocide Foundation and the Promise Institute for Human Rights at UCLA School of Law.

This event will be in person for WA members. \nDavid Hodgkinson will be speaking to the implications for Australia and Western Australia from the International Energy Agency’s report Net Zero by 2050: a Roadmap for the Global Energy Sector. \nThe presentation will be followed by networking and refreshments. \nNELA(WA) 2021 State Conference delegates are able to attend this event for free\, due to the change of program at the conference. \nDavid Hodgkinson \nDavid is an associate professor and co-director of the Centre for Energy\, Mining and Natural Resources Law in the Faculty of Law at the University of Western Australia. He was formerly Director of Legal Services at the International Air Transport Association (IATA)\, the organisation of the world’s airlines\, in Montreal and Geneva. \nHe holds a Bachelor of Arts degree (First Class Honours) and Bachelor of Laws and Master of Philosophy degrees. He was also a postgraduate fellow at Columbia University in New York City. Earlier in his career he was Senior Legal Research Officer at the High Court of Australia where he worked mostly for Justice Sir William Deane. \nDavid is the co-author of the book Global Climate Change: Australian Law and Policy (2008)\, the standard Australian text on climate change law\, and the editor of Climate Change Law and Policy in Australia. He has also written refereed journal articles\, book chapters\, monographs and opinion pieces on climate change law and policy\, and spoken at (and convened) conferences on climate change around the world. \nHe was the principal draftsperson of the Peninsula Principles on Climate Displacement\, and the general editor of the loose-leaf service Australian Climate Change Law and Policy.

SUMMARY:Webinar: The Legal Protection of the Amazon: Current and Future Trends
DESCRIPTION:Organised by the Western Sydney University School of Law in collaboration with Griffith University’s Tropical Primary Forests and Climate Change project\, Cardiff School of Law & Politics School and Sabin Center for Climate Change Law at the Columbia Law School\, this webinar will shed light on how legislation\, domestic and international litigation\, market-based mechanisms\, and private sector initiatives may contribute to protecting the Amazon. This will be also an opportunity to discuss the outcomes of COP 26 that may be relevant to the Amazon.\nThe Amazon is being led to the ‘point of no return’ \nThe recent Amazon fires of 2019 and 2020 have heightened attention on the region and brought the question of Amazon conservation to the forefront of international debate. The crucial role of primary forests\, such as the Amazon\, in preventing catastrophic biodiversity loss and climate change is largely recognized in the scientific literature and in policy  forums. The latest IPCC report\, described by the UN Secretary General as a ‘red code for humanity\,’ is a call for deep reductions in GHG emissions and the protection of carbon sinks. However\, the trends in agriculture and livestock expansion\, fires\, drought\, logging\, and mining are leading the Amazon to the ‘point of no return’\, as warned by scientists and as recognised by a recent motion passed in the International Union for Conservation of Nature (IUCN) World Congress in Marseille in 2021. \nThis webinar discusses the recent Special Issue on ‘The Amazon Rainforest’ which was prepared through a collaboration of academics from around the world and published by the Review of European\, Comparative and International Environmental Law (RECIEL).

SUMMARY:The Role of the Paris Agreement Implementation and Compliance Committee
DESCRIPTION:The Paris Agreement is an international treaty that sets out a global framework to avoid dangerous climate change by limiting global warming to well below 2°C and preferably to 1.5°C. The Paris Agreement Implementation and Compliance Committee (PAICC) is co-chaired by Haseeb Gohar (Pakistan) and Dr Christina Voigt (Norway). The PAICC functions in a transparent\, non-adversarial and non-punitive manner\, paying attention to the respective national capabilities and circumstances of treaty parties. \nDr Christina Voigt will present on the role of the PAICC to facilitate implementation of and promote compliance with the provisions of the Paris Agreement. \nDr Christina Voigt\nDr Christina Voigt is a renowned expert in international environmental law and professor at the University of Oslo. She is passionate about legal issues of climate change\, environmental multilateralism\, and sustainability. Dr Voigt has published widely on these topics and is a frequent speaker at international and national events. \nFor more than 10 years\, she also worked as legal adviser and negotiator for the Government of Norway in the UN climate negotiations. She is currently the first co-chair of the PAICC. \nDr Voigt is the chair of the Climate Change Specialist Group of the IUCN World Commission on Environmental Law and a member of the IUCN Climate Change Task Force. She is the official candidate for the position of chair of the IUCN World Commission on Environmental Law\, for election at the IUCN World Conservation Congress in 2021.

DESCRIPTION:Mapping the regulation of mine closure: a CRC time project \nPresented by Professor Alex Gardner and Laura Hamblin \nThe project (15 March – 24 December 2021) has three stages in mapping the Australian regulation of mine closure\, focusing on Queensland\, Victoria\, Western Australia and the Commonwealth: \n\nKey concepts\, goals and institutions.\nThe current regulatory frameworks found in the legislation for mining\, environmental protection\, water resources and land use planning.\nThe experience with the current regulatory frameworks & potential reforms.\n\nThroughout the drafting of stages 1 & 2 of the report\, five key points have been identified: \n\nQueensland and Victoria’s legislative regimes have greater statutory detail\, whilst Western Australia relies more heavily on guidelines and policy.\nQueensland and Western Australia use a pooled monetary fund as a form of financial security for rehabilitation. Victoria uses a system of bonds.\nQueensland and Victoria have dedicated administrative bodies which manage mine closure\, whilst Western Australia does not.\nAll three states require mine closure plans to be updated at periodic intervals.\nWhilst mining tenement holders must meet both state and federal regulatory requirements\, when mines are in the closure phase soft law including industry standards is often used as the reference point as it is able to evolve more rapidly.\n\nZOOM details to be circulated prior to the event.

SUMMARY:Advancing and mainstreaming the rights of future generations
DESCRIPTION:If we are to address the multiple and complex issues of our time there can be no more urgent a task than integrating intergenerational thinking into our environmental planning and broader decision making. This can be achieved through the establishment of a Parliamentary Committee for the Future and the appointment of a National Future Generations Commissioner. \nThis presentation will look at the role of the world’s first Future Generations Commissioner in Wales and learnings from their recent review\, as well as the development of The Wellbeing of Future Generations Bill currently in the British Parliament.\nFinally\, and most importantly\, children and young people to actively participate as citizen stakeholders in policy development and decision making. Young people play an invaluable role and have ownership in the future they are creating and inheriting.

DESCRIPTION:The Piddington Society and National Environmental Law Association are coming together to discuss legal and policy developments in climate change. You will hear from three speakers who will cover the arc of development\, current issues in the area and policy and regulatory responses to climate change.\n\nSpeakers include the Hon Michael Barker QC and Zoe Bush (EDO)\, with another speaker to be announced closer to the event. Mr Barker QC will cover the development of the law in this area over the past 30 years and Ms Bush will speak to current climate change legal issues.
