SUMMARY:The OECD Guidelines and Environmentally Responsible Business Conduct
DESCRIPTION:What does environmentally responsible business conduct look like? \nCan businesses be held accountable to address the environmental impacts of their activities? \nThe OECD Guidelines for Multinational Enterprises (OECD Guidelines) are internationally agreed standards for responsible business conduct\, which address environmental impacts as well as human rights\, labour relations\, consumer interests and other areas. Australia is one of 50 countries which has joined the OECD Guidelines\, encouraging multinational enterprises to observe these standards; and establishing a National Contact Point (the Australian National Contact Point – within the Commonwealth Department of the Treasury). \nJoin NELA (WA) and Curtin Law School for a workshop which provides an overview of the application of the OECD Guidelines to cases involving environmental issues\, and examines the practicalities of a complaint to the Australian National Contact Point (AusNCP) regarding the environmental chapter of the OECD Guidelines. \n1.5 CPD points are available (0.5 in CA 2 – Professional Skills\, 0.5 in CA 3 – Ethics or Professional Responsibility; and 0.5 in CA 4 – Substantive Law) \nThis workshop is free for NELA members and NGO sector attendees\, and $20 for non-members. \n  \nSpeakers \nJohn Southalan – Independent Examiner\, AusNCP for Responsible Business Conduct \nJohn is a mediator\, barrister and academic with extensive experience in responsible business conduct and dispute resolution. He has a part-time role as an Independent Examiner with the AusNCP for Responsible Business Conduct\, dealing with complaints against companies about the OECD Guidelines for Multinational Enterprises. \nJo Feldman – Partner\, Norton Rose Fulbright \nJo is an arbitration and litigation lawyer; with over 17 years’ experience working with government and the private sector.  She has broad experience in disputes under national laws and international law\, and has acted for and against States in investment treaty arbitrations. \nJo is also experienced in human rights law\, and Environmental\, Social and Governance (ESG) issues. She was Australia’s lead on human rights at the United Nations in New York\, and was Vice Chair of the UN Commission on the Status of Women\, chairing the negotiation of the Political Declaration to mark the 25th anniversary of the Beijing Declaration and Platform for Action. \nJoseph Wilde-Ramsing – Senior Advisor\, OECD Watch \nJoseph is a researcher\, advisor and advocate with broad experience and expertise in corporate accountability across a wide range of sectors\, including energy\, extractives\, manufacturing and finance. Joseph frequently assists communities and workers in documenting human rights and environmental violations\, asserting their rights and seeking remedy for corporate abuse. Joseph is on the Advisory Board of the Dutch National Contact Point for the OECD Guidelines.

SUMMARY:Partner webinar: Ecocide as a new international crime
DESCRIPTION:This webinar hosted by several organisations in the Asia-Pacific region\, including NELA’s partner organisation\, the Asian Research Institute for Environmental Law\, presents an expert panel who will consider the proposed definition for the crime of ecocide.\nThe Independent Expert Panel for the Legal Definition of Ecocide\, chaired by barrister and author Philippe Sands QC (UK) together with UN jurist and former prosecutor Dior Fall Sow (Senegal)\, was convened in late 2020 at a powerfully symbolic moment\, 75 years after the terms “genocide” and “crimes against humanity” were first used at Nuremberg.\nCommissioned by the Stop Ecocide Foundation\, an expert drafting panel of 12 highly renowned international criminal and environmental lawyers from around the world has just concluded six months of deliberations. The result: a legal definition of “ecocide” as a potential 5th international crime\, to sit alongside genocide\, crimes against humanity\, war crimes and the crime of aggression.\nThe proposed definition of Ecocide is available on the newly launched Ecocide Law website\, an academic and legal resource hub co-managed by the Stop Ecocide Foundation and the Promise Institute for Human Rights at UCLA School of Law.

SUMMARY:Webinar: The Legal Protection of the Amazon: Current and Future Trends
DESCRIPTION:Organised by the Western Sydney University School of Law in collaboration with Griffith University’s Tropical Primary Forests and Climate Change project\, Cardiff School of Law & Politics School and Sabin Center for Climate Change Law at the Columbia Law School\, this webinar will shed light on how legislation\, domestic and international litigation\, market-based mechanisms\, and private sector initiatives may contribute to protecting the Amazon. This will be also an opportunity to discuss the outcomes of COP 26 that may be relevant to the Amazon.\nThe Amazon is being led to the ‘point of no return’ \nThe recent Amazon fires of 2019 and 2020 have heightened attention on the region and brought the question of Amazon conservation to the forefront of international debate. The crucial role of primary forests\, such as the Amazon\, in preventing catastrophic biodiversity loss and climate change is largely recognized in the scientific literature and in policy forums. The latest IPCC report\, described by the UN Secretary General as a ‘red code for humanity\,’ is a call for deep reductions in GHG emissions and the protection of carbon sinks. However\, the trends in agriculture and livestock expansion\, fires\, drought\, logging\, and mining are leading the Amazon to the ‘point of no return’\, as warned by scientists and as recognised by a recent motion passed in the International Union for Conservation of Nature (IUCN) World Congress in Marseille in 2021. \nThis webinar discusses the recent Special Issue on ‘The Amazon Rainforest’ which was prepared through a collaboration of academics from around the world and published by the Review of European\, Comparative and International Environmental Law (RECIEL).
