SUMMARY:The Role of the Paris Agreement Implementation and Compliance Committee
DESCRIPTION:The Paris Agreement is an international treaty that sets out a global framework to avoid dangerous climate change by limiting global warming to well below 2°C and preferably to 1.5°C. The Paris Agreement Implementation and Compliance Committee (PAICC) is co-chaired by Haseeb Gohar (Pakistan) and Dr Christina Voigt (Norway). The PAICC functions in a transparent\, non-adversarial and non-punitive manner\, paying attention to the respective national capabilities and circumstances of treaty parties. \nDr Christina Voigt will present on the role of the PAICC to facilitate implementation of and promote compliance with the provisions of the Paris Agreement. \nDr Christina Voigt\nDr Christina Voigt is a renowned expert in international environmental law and professor at the University of Oslo. She is passionate about legal issues of climate change\, environmental multilateralism\, and sustainability. Dr Voigt has published widely on these topics and is a frequent speaker at international and national events. \nFor more than 10 years\, she also worked as legal adviser and negotiator for the Government of Norway in the UN climate negotiations. She is currently the first co-chair of the PAICC. \nDr Voigt is the chair of the Climate Change Specialist Group of the IUCN World Commission on Environmental Law and a member of the IUCN Climate Change Task Force. She is the official candidate for the position of chair of the IUCN World Commission on Environmental Law\, for election at the IUCN World Conservation Congress in 2021.

DESCRIPTION:Mapping the regulation of mine closure: a CRC time project \nPresented by Professor Alex Gardner and Laura Hamblin \nThe project (15 March – 24 December 2021) has three stages in mapping the Australian regulation of mine closure\, focusing on Queensland\, Victoria\, Western Australia and the Commonwealth: \n\nKey concepts\, goals and institutions.\nThe current regulatory frameworks found in the legislation for mining\, environmental protection\, water resources and land use planning.\nThe experience with the current regulatory frameworks & potential reforms.\n\nThroughout the drafting of stages 1 & 2 of the report\, five key points have been identified: \n\nQueensland and Victoria’s legislative regimes have greater statutory detail\, whilst Western Australia relies more heavily on guidelines and policy.\nQueensland and Western Australia use a pooled monetary fund as a form of financial security for rehabilitation. Victoria uses a system of bonds.\nQueensland and Victoria have dedicated administrative bodies which manage mine closure\, whilst Western Australia does not.\nAll three states require mine closure plans to be updated at periodic intervals.\nWhilst mining tenement holders must meet both state and federal regulatory requirements\, when mines are in the closure phase soft law including industry standards is often used as the reference point as it is able to evolve more rapidly.\n\nZOOM details to be circulated prior to the event.

He has practised environmental and planning law in Queensland\, Victoria and New South Wales and has worked in the public\, private and non-profit sectors\, including at the Victorian Department of Premier and Cabinet\, Clayton Utz and Corrs Chambers Westgarth. DESCRIPTION:The Western Australian Waste industry has seen a number of new developments in legal and policy framework\, including amendments to Environmental Protection Act 1986 (WA) and the publication of papers by the Department of Water and Environmental Regulation (DWER) addressing the closed loop economy\, waste derived materials and the waste levy.\n\n\nJoin NELA at the University of Western Australia at 3:30pm on 17 June 2021 to hear from legal and industry professionals who will present on these new developments which the waste industry has or will experience.\n\nSpeakers include:\nCraig Wallace\, Partner at Lavan Legal\nCraig Wallace specialises in all aspects of town planning and environmental law as it pertains to property development and land use. Craig has almost 20 years’ experience in a wide range of matters for developers and government clients including providing advice on all aspects of developments and subdivision approvals\, environmental approvals (both State and Federal)\, advice on strategic framework and policy documents\, advocacy at all levels of the decision making process in a planning and environmental context.\nMarcus Geisler\, Chief Executive Officer of the Eastern Metropolitan Regional Council\nMarcus Geisler became the CEO of the EMRC in July 2019 and is the former chair of the WA Waste Authority. This can be achieved through the establishment of a Parliamentary Committee for the Future and the appointment of a National Future Generations Commissioner. \nThis presentation will look at the role of the world’s first Future Generations Commissioner in Wales and learnings from their recent review\, as well as the development of The Wellbeing of Future Generations Bill currently in the British Parliament.\nFinally\, and most importantly\, children and young people to actively participate as citizen stakeholders in policy development and decision making. Young people play an invaluable role and have ownership in the future they are creating and inheriting.

SUMMARY:Indigenous Knowledge in Environmental Decision-Making
DESCRIPTION:Speakers inlcude: \nDr Judith Preston – Dr Preston is a lawyer in New South Wales and recently wrote a thesis which considered the question of how Indigenous knowledge can be more effectively integrated into Australian environmental decision- making to achieve both beneficial outcomes for environmental protection as well as Aboriginal self-determination. Judith commenced work in 1982 with the Northern Land Council (NLC) primarily representing Aboriginal Traditional Owners in land claims in the Northern Territory and related to other legal needs of Aboriginal communities in the NLC jurisdiction. She was instrumental in establishing the first public interest environmental law centre\, the Environmental Defender’s Office. She has since worked in a number of leading legal practices and teaches at Macquarie University. \nPhil Duncan – Phil Duncan is from Moree New South Wales and is a member of the Gomeroi Nation and an elected representative of the Gomeroi Nation Native Title Claimant Group. His homelands are Moree and Terry Hie Hie. Phil is experienced in working and collaborating with Aboriginal people and government to improve the lives of Aboriginal people through recognition of rich Aboriginal cultural history\, the return of Aboriginal lands and the improvement of First Nation living conditions. Phil has made significant contributions in a variety of domains from education and organisational reconciliation action through to areas of focus such as cultural heritage\, natural resource management\, freshwater river management\, forestry\, native fish\, water rights and allocations. \n\n\n\nProfessor Donna Craig – Donna Craig is a specialist in international\, comparative and national environmental law and policy at Western Sydney University. She was one of the earliest academics to specialise in environmental law (from 1976) and has researched and taught across a wide range of environmental law areas and jurisdictions. She has also made significant research and teaching contributions in aspects of Biodiversity Law (relating to the recognition of knowledge and practices of Indigenous and local communities\, intellectual and cultural property rights\, recognition of customary laws and community based environmental management)\, participatory approaches to environmental decision-making\, environmental impact assessment and social impact assessment. Donna has over 40 years’ experience in environmental law research\, legal practice\, teaching and working with communities\, NGO’s\, environmental organisations\, governments and corporations. \nTaylor Clarke – Taylor Clarke is a Gundungurra woman from Warragamba. Her people are the Bidjiwong (Water Dragon) people of Burragorang Valley. Taylor is an activist and conservationist\, working to protect her Country in the Burragorang Valley. Working as a consultant on issues regarding Indigenous culture\, conservation\, sustainability\, land use and development with local councils and governments\, Taylor champions the ‘Give a Dam’ campaign to stop the raising of Warragamba Dam wall. Taylor is a story-teller and travels across Australia sharing the history of her people. Her hope for the future is to foster a more connected relationship with Indigenous environment groups internationally as so many are facing the same issues.”We do not own the land; the land owns us. SUMMARY:Re-imagining the laws of nature - the Samuel Review of the EPBC Act and futures-focused biodiversity law
DESCRIPTION:Tickets: FREE for members and $20 for non-members \nDr Michelle Lim’s interdisciplinary scholarship occurs at the intersection between biodiversity conservation and sustainable livelihoods. Dr Lim’s work focuses on futures-oriented biodiversity law research aimed at advancing equity and sustainability under conditions of unprecedented environmental change. \nDr Lim has published in some of the highest ranked environmental law journals (e.g. International Environmental Agreements – Politics Law and Economics; Transnational Environmental Law; Review of European Comparative and International Environmental Law) as well as significant sustainability journals (e.g. Nature Sustainability\, Ecology & Society\, Current Opinion in Environmental Sustainability). \nDr Lim holds a double degree in Science (Ecosystem Management) and Law (First-class Honours) and a PhD on legal and institutional arrangements for transboundary biodiversity conservation at the University of New England\, Australia. \nDr Lim joined the Macquarie Law School as a Senior Lecturer in 2020. Prior to this she was a Lecturer at the University of Adelaide and Griffith University. Dr Lim’s post-doctoral research\, based at the UNESCO Centre for Water Law\, Policy and Science at the University of Dundee\, Scotland\, examined governance approaches for addressing ecosystem services and human well-being in the Ganges Brahmaputra Meghna Delta. \nDr Lim was a fellow on the Global Assessment of the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES). She is the Book Review Editor of the Oxford Yearbook of International Environmental Law and sits on the Editorial Board of the Australian Environment Review. Dr Lim is also a Board Member of the National Environmental Law Association. Dr Lim was awarded the 2016/2017 Law Council of Australia Mahla Pearlman Australian Young Environmental Lawyer of the Year Award.

In 1989 NELA awarded Simon the then Australian Environmental Law Award for being a person who has ‘made an outstanding contribution to the development and understanding of environmental law in Australia’. In 2020 NELA conferred on Simon the distinction of honorary life membership. Simon has formerly served as an Acting Justice of the Land & Environment Court of NSW\, a Senior Legal Member of two Victorian tribunals\, a Vice-Chancellor’s Professorial Fellow at Monash University and Adjunct Professor in Social & Environmental Sustainability at La Trobe University. He was instrumental in the foundation of the first environmental law association in Australia – the Environmental Law Section of the Law Institute of Victoria\, then NELA\, the Environment Institute of Australia & New Zealand\, Australian Environmental Defenders’ Office  and the International National Trusts Organisation\, all of which he has led for many years. Successive governments at both State and Federal levels have appointed him to numerous boards\, advisory committees and commissions. Australia has recognised his achievements by honouring him as a Member of the Order of Australia in 1994\, awarding him the Centenary Medal in 2001 and then elevating him to Officer of the Order of Australia in 2012. Recently the State Government has: \n\nrun a large program for the receipt of public submissions on the papers ‘Closing the Loop: Waste reforms for a circular economy’ and ‘Review of the waste levy – consultation paper;’\nplanned to introduce the Container Deposit Scheme in October 2020; and\npublished the Waste Avoidance and Resource Recovery Strategy 2030 which outlines the aim to increase the recovery of material in the C&D Sector to 80% by 2030.\n\nWith this in mind\, the Construction & Demolition industry\, a sector which makes up around half of Western Australia’s waste stream\, is primed for innovation. \nThis seminar brings together leading specialists to present their perspectives on the challenges and opportunities for the future uptake of recycled construction and demolition products in Western Australia.

SUMMARY:Frontiers of Environmental Law Colloquium
DESCRIPTION:The annual Frontiers in Environmental Law Colloquium provides a forum for environmental law \nacademics and practitioners to share and discuss their experiences\, research and teaching practices. Through a supportive forum\, we aim to: \n\nFoster a supportive and inclusive network of like-minded individuals;\nExplore innovative environmental law ideas and insights with and beyond our discipline;\nContribute meaningfully to the future of environmental law in our region;\nShare approaches to teaching and learning in environmental law; and\nAssist environmental law academics to actively build their careers\n\nColloquium Themes for 2020\nEnvironmental law is wide-ranging in its scope and ambitions and draws from diverse legal traditions \nand techniques as well as multi-disciplinary and theoretical knowledge. As in previous years\, we invite papers that engage with the ideas of frontiers and boundaries. There are four key themes for the 6th Colloquium in 2020: \n\nJurisdictional insights: exploring contemporary environmental law developments and future\nhorizons in specific jurisdictions (state and Federal)\, as well as comparative analyses across Australian state and/or national boundaries;\nLaw in action: examining the practical application of law on-the-ground\, including implementation issues\, critical analyses of case law\, compliance and non-compliance concerns\, and the challenges of law enforcement;\nTowards best practice: showcasing innovative approaches to current environmental problems\, particularly in the areas of natural resource extraction (living and non-living\, marine or terrestrial)\, and environmental law responses to our changing climate; and Multi-disciplinarity: highlighting methodological challenges and substantive issues at the\nintersection of environmental law and science\, technology\, engineering\, economics\, culture and the Arts etc.\n\nAbstract submission\nWe invite proposal for research presentations on any of the above themes\, and/or in relation to \nteaching environmental law. Abstracts should be no more than 300 words and submitted using the attached abstract proposal form. The due date for abstracts is the 31st October 2019\, and they should be sent to erika.techera@uwa.edu.au. \nProgram\nThe Colloquium will be held in the UWA Law School on the Crawley Campus of The University of \nWestern Australia – https://www.web.uwa.edu.au/ data/assets/pdf_file/0008/3373442/Crawley- campus-map-alphabetical-2018.pdf. The Colloquium will be conducted in an interactive\, workshop style format\, involving brief presentations\, panel discussions\, and Q&A. A detailed program will be available in late December 2019. \nPublication\nThere will be a registration fee of $100 (+GST) to cover catering for the two days. A Colloquium \ndinner will be held on the Thursday night\, at the expense of individual participants. Unfortunately\, we are not able to assist with travel and accommodation costs. \nAccommodation\nAccommodation is available on the perimeter of the UWA campus during the summer break\, within \neasy walking distance of the UWA Law School. SUMMARY:Climate Change and Environmental Legislation (Perth)
DESCRIPTION:A Climate Change Model Statute Sustainable Development Law How a Modern Environmental Appeals Jurisdiction would work. \nHow can climate change be accommodated within environmental law? This one day conference will consider how environmental laws can be reformed to accommodate climate change and sustainable development concepts\, internationally and in Western Australia. A panel of eminent speakers has been assembled to address these important issues. \nEnvironmental protection statutes around the world generally have limited capacity to deal with climate change and sustainable development. Traditional models of causation and remoteness of damage\, for example\, do not relate easily to climate change related events\, with the consequence that governments may look to innovative models to transfer climate risk to the private sector. \nRecognising the international nature of these issues\, the International Bar Association (IBA)\, as the global voice of the legal profession\, established in 2014 an expert Working Group to draft a model climate law statute. \nThe model statute is designed to be a resource for legislatures\, government departments and judiciaries\, with potential statutory provisions to assist in addressing climate change\, in particular to enhance mitigation and adaptation measures. \n
